W ostatnim czasie szerokim echem odbiła się uchwała Sądu Najwyższego z dnia 30 września 2025 roku, sygn. akt: III PZP 6/24. Sąd Najwyższy rozstrzygnął w niej ważną wątpliwość pracodawców, orzekając, że wynikający z art. 39 Kodeksu pracy zakaz wypowiedzenia umowy o pracę dotyczy także umowy zawartej na czas określony, w tym także takiej, której okres obowiązywania upływa przed osiągnięciem przez pracownika wieku emerytalnego. Uchwała ta ma istotne znaczenie dla polityki kadrowej, a w poniższym artykule zwrócimy uwagę na kilka ważnych aspektów z nią związanych.
Interpretacja SN co do zakresu ochrony przedemerytalnej
W pierwszej dla pracodawcy kolejności istotna jest sama treść uchwały Sądu Najwyższego, która zawiera interpretację przepisu art. 39 Kodeksu pracy. Jest to przepis, który ustanawia tzw. ochronę przedemerytalną, tj. zakaz wypowiadania umowy o pracę pracownikowi, któremu brakuje nie więcej niż 4 lata do osiągnięcia wieku emerytalnego, jeżeli okres zatrudnienia umożliwia mu uzyskanie prawa do emerytury z osiągnięciem tego wieku. Praktyczne znaczenie tego przepisu jest duże, bo może on mieć zastosowanie co do zasady do każdego pracownika spełniającego określone kryterium wieku.
Z punktu widzenia pracodawców, bardzo ważna jest świadomość istnienia tego przepisu prawa. Pozwala ona na odpowiednie kształtowanie polityki kadrowej i unikanie negatywnych następstw ewentualnego naruszenia tego przepisu. Należy bowiem pamiętać, że następstwa naruszenia art. 39 Kodeksu pracy mogą mieć doniosłe konsekwencje finansowe jak również organizacyjne.
W tym kontekście pracodawcy mogli mieć wątpliwość, co do zastosowania przepisu art. 39 Kodeksu pracy w sytuacji, kiedy wypowiedzenie umowy o pracę miałoby dotyczyć pracownika znajdującego się w wieku przedemerytalnym, jednak zatrudnionego na podstawie umowy o pracę na czas określony, która kończyła się przed osiągnięciem przez tego pracownika wieku emerytalnego. Celem przepisu art. 39 Kodeksu pracy jest w szczególności umożliwienie pracownikowi dopracowania do emerytury. Natomiast w przypadku, którego dotyczyła uchwała Sądu Najwyższego, pracodawca nie miał obowiązku zawierania kolejnej umowy o pracę, a okres zatrudnienia nie zapewniał pracownikowi pracy aż do emerytury. W związku z tym ochrona w przypadku tego pracownika nie zapewniłaby osiągnięcia celu w postaci dopracowania do emerytury.
Sąd Najwyższy rozstrzygnął powyższe wątpliwości uznając za właściwe szersze stosowanie ochrony przedemerytalnej, w tym również do sytuacji opisanej powyżej.
Przepisy prawa pracy a ich interpretacja
Powyższa uchwała stanowi dobry przykład tego, że poszczególne przepisy prawa pracy mogą być interpretowane w różny sposób. Dotyczy to przy tym nawet zagadnień o podstawowym znaczeniu dla praktyki stosowania prawa pracy oraz przepisów, których treść nie jest nadmiernie rozbudowana czy zawiła. Przepis art. 39 Kodeksu pracy składa się tylko z jednego zdania. Pomimo tego wywołał on na tyle poważne wątpliwości co do jego interpretacji, że Sąd Okręgowy orzekający na co dzień w sprawach z zakresu prawa pracy nie był pewny jaki jest zakres jego zastosowania i zwrócił się o wykładnię do Sądu Najwyższego. Na marginesie należy dodać, że interpretacja zawarta w ww. uchwale Sądu Najwyższego nie uzyskała aprobaty wszystkich sędziów Sądu Najwyższego, którzy brali udział w jej podejmowaniu. Dwóch spośród siedmiu zgłosiło bowiem zdania odrębne.
Nie jest jednak właściwym wnioskiem uznanie, że nie ma sensu poświęcać uwagi prawu pracy, a każdy przepis może być interpretowany dowolnie. Rzeczywiście jest możliwość występowania wielu interpretacji przepisów prawa pracy, a w pewnych przypadkach wybór prawidłowej jest trudny. Prawdą jest również, że nie ma stuprocentowej pewności jaką interpretację w danym przypadku zastosuje Państwowa Inspekcja Pracy lub sąd pracy.
Możliwe jest jednak działanie oparte na bardziej powszechnych i racjonalnych interpretacjach przepisów prawa pracy, które z dużym prawdopodobieństwem zostaną następnie zaakceptowane przez organy zajmujące się stosowaniem prawa. Takie postępowanie wymaga jednak często znajomości literatury prawa pracy, orzecznictwa sądów pracy oraz praktyki działania Państwowej Inspekcji Pracy. Sama znajomość przepisu prawa pracy może być niewystarczająca.
Znaczenie orzecznictwa sądów pracy
Szczególnie znaczenie dla interpretacji przepisów prawa pracy ma dorobek orzecznictwa sądów pracy, tj. poglądy sądów na poszczególne zagadnienia, które zostały przedstawione w uzasadnieniach uchwał, wyroków lub postanowień sądów, wydanych na kanwie określonych stanów faktycznych. Poglądy te zasadniczo mają charakter wiążący wyłącznie co do konkretnej sprawy, w ramach której zostały przedstawione. Jednakże ich znaczenie wykracza poza tylko indywidualne przypadki. Uzasadnienia orzeczeń dotyczących prawa pracy stanowią materiał pomocniczy, który pomaga dokonywać interpretacji prawa we wszystkich podobnych przypadkach i stanach faktycznych. Na ich podstawie możliwe jest również szacowanie ryzyka związanego z przyjęciem określonej interpretacji prawnej.
