The client, a real estate company, was looking for investment opportunities in challenging assets. They were interested in a receivable secured by a mortgage and subject to years of unsuccessful enforcement proceedings. Thanks to the comprehensive support of the ARTE LEGAL team, this investment was not only completed but also resulted in a significant profit.
Our law firm conducted a comprehensive legal analysis of the receivable and its enforcement, identifying realistic prospects for satisfaction. Based on this, we developed the structure and content of the conditional assignment agreement. Following its execution, we represented the client in the enforcement proceedings, facilitating the successful commencement of the proceedings, the acquisition of the property at auction, and its management. The ARTE LEGAL team also oversaw the property acquisition process and relations with its tenants.
As a result, the client acquired the receivable for PLN 1.1 million, paid an additional PLN 650,000 for the property worth approximately PLN 3.4 million, and, upon its sale, realized a profit of approximately PLN 1.65 million.
